Emerging Photographers Commission Terms and Conditions

By submitting your application for the Open Call Emerging Photographers Commission, part of 'The Way We Live', you are accepting the following Terms and Conditions. This agreement constitutes the entire and only agreement between you and The Box Plymouth.

1. I confirm all the works submitted are my own and I have the intellectual copyright to use, exhibit and distribute them.

2. I am not a staff member at The Box Plymouth.

3. I understand that the name, captions, texts and images or moving image files I share for the Open Call Emerging Photographers commission will be reviewed by The Box Plymouth curatorial staff to create a shortlist, and the commissions will be selected by a panel.

4. Unless agreed otherwise, The Box Plymouth will only accept applications submitted through the ‘How to apply’ process and cannot offer feedback on any individual application.

5. If selected, I allow my images to be used in print and online (including social media and other platforms) for marketing, press, promotional and educational purposes related to the programme and The Box Plymouth’s wider activities. Any images used will be fully credited when sent to press and third parties by The Box Plymouth. Copyright for all texts and images is retained by their respective author.

6. Copyright and ownership of the completed work will remain with the artist, however a condition of the commission will include an exclusive right to reveal and exhibit the work prior to any other public display, and that any future exhibition or public display of the work acknowledges that it was commissioned by The Box, Plymouth.

7. If my application is successful, my name, text and selected works, can be uploaded to The Box Plymouth website and will be accessible to the public. My work will remain part of The Box Plymouth’s online archive for an indefinite period. Occasionally images may be cropped for purposes of fitting into the website format, this will only be done when absolutely necessary.

8. The Box Plymouth reserves the right to edit gallery texts submitted through the commissioning process, this will be done in consultation with the artist.

9. All submitted information, text and images are my sole responsibility, not The Box Plymouth, and do not breach any third-party copyright. I am entirely responsible for all content that I have uploaded or make otherwise available.

10. I do not hold The Box Plymouth, including all its staff and trustees, responsible for any losses, claims, liabilities, expenses, damages and costs, including reasonable legal fees, resulting from any violation of these Terms and Conditions or any activity related to the service (including negligent or wrongful conduct) by myself or any other person.
